This session will provide practitioners with tips, examples and the tools to argue cases under the test of unjustifiably harsh consequences/exceptional circumstances under Article 8 ECHR.
This course will cover:
• When ‘exceptional circumstances’ / ‘unjustifiably harsh consequences’ arise
• Appendix FM GEN 3.1-3.3 of the Rules
• Appendix FM SE Para 21(A)
• Home Office Policy Guidance and how to make best use of it
• Authorities on ‘unjustifiably harsh consequences’ – with analysis of circumstances the Courts have found to meet the test and those which they have not been convinced by
• Case studies
Audience: This course provides an overview for those beginning in this area or are seeker a refresher.
Tutor: Priya Solanki, One Pump Court Chambers
Priya is a busy and experienced specialist in immigration, asylum, human rights and nationality law. She appears regularly before Courts and Tribunals.
She has a particular interest in and experience of cases involving vulnerable clients. She is known to have a very calming and reassuring manner with clients with vulnerabilities.
Priya has recently authored two books. One on Challenging Sham Marriage Allegations. More recently she has written a book on Migrant Victims of Domestic Violence - http://www.lawbriefpublishing.com/product/migrantvictimsofdomesticviolence/
She regularly provides in-house training, seminars and webinars.
She is cited as a leading junior in Immigration (including business immigration) in Legal 500 with the Directories stating, “she has a sharp mind and demonstrates excellent client care”, "she is tactically astute, good under pressure and very persuasive in court" and "she is very knowledgeable in presenting appeals".
Priya has also recently been appointed as a Deputy Upper Tribunal Judge (Immigration and Asylum).

Yes. All attendees are sent a copy of the slides/course materials 2 days before the webinar. You are not permitted to share these materials.
Yes. If you cancel an order over 7 days before the event, you are entitled to a refund of 100% minus the Eventbrite booking fee. You cannot claim a refund within 7 days of the webinar. If you fail to attend an event you are not entitled to a refund.
You can transfer your registration for a charge of £5. If the substitute is liable for a higher fee than the person they are replacing then the balance of the fee must be paid in full before the replacement is admitted to the course. If you have any questions please email training@ilpa.org.uk
