Mae'r amrywiaeth eang o gytundebau diwydiant cerddoriaeth sydd ar gael ar hyn o bryd a gymhlethdod y derminoleg a ddefnyddir yn barhau i fod yn faes dryslyd ar gyfer yr anwyliadwrus.

The wide variety of music industry agreements to be currently found, and the complexity of terminology used, remains a confusing and vexing area for the unwary. 

  • Sut ydych chi'n gwybod os ydych yn cael cynnig gytundeb teg a rhesymol?

  • Beth ydy’r parti arall yn ei ddisgwyl oddi wrthoch chi (a nhw gennych chi)?

  • How do you know if you are being offered a fair and reasonable agreement? 
  • What rights are being sought from you? 
  • What does the other party expect from you (and you from the other party)?
  • What might the implications be of signing without obtaining independent legal advice? 

Ymunwch â Mark Melton cyfreithiwr diwydiant cerddoriaeth a Paul Gray o Undeb y Cerddorion am drosolwg o'r cytundebau fwyaf cyffredin a welir gan gerddorion a chyfansoddwyr.

Byddwn hefyd yn edrych ar yr hyn y gellir ei gynnwys mewn cytundebau cychwynnol "Heads of Agreement" hyd at gytundebau "ffurf hir"  llawn.

Join music industry lawyer Mark Melton and the MU’s Paul Gray for an overview of the various agreements that musicians and songwriters are most commonly presented with.

We’ll also look at what may be included in an initial “Heads of Agreement” and follow that through to a full “long-form” contract.

  • Hawlfreintiau allweddol a thrwydded (i gymharu ag) aseiniad.

  • Cymalau, eu hystyr a goblygiadau.
  • Pwyntiau breindaliadau, opsiynau, darpariaethau cyfrifo, blaendaliadau, terfynu, y Gyfraith ac Awdurdodaeth.
  • Pwyntiau allweddol i fod yn ymwybodol, ac yn wyliadwrus ohonynt.
  • Defnyddio cytundebau syml Undeb y Cerddorion - cyd-ysgrifennu, rhannu caneuon a chyn-recordio.
  • Pwysigrwydd cael cyngor cyfreithiol annibynnol a gwasanaeth Cynghori Cytundeb a Gwasanaeth Ôl-ofal “am ddim” Undeb y Cerddorion.

Areas covered will include:

  • Synchronisation, Recording, Management, Music Publishing and Licensing Agreements.
  • Key copyrights and license v assignment.
  • Definitions of key terminology.
  • Clauses, their meaning and implications.
  • Royalty points, options, accounting provisions, advances, termination, Law & Jurisdiction.
  • Key points to be aware, and wary of.
  • Using simple MU agreements - co-writing, Song Share and pre-recording.
  • The importance of seeking independent legal advice and the MU’s free Contract Advisory and Aftercare Service.

Mark Melton is an entertainment lawyer with P. Russell & Co Solicitors. He has over 25 years of experience in copyright law and negotiating music business and other entertainment agreements at every level.

P. Russell & Co administers the Contracts Advisory Service on behalf of The Musicians’ Union. This service provides an initial free one hour consultation for members who have been offered music business agreements such as recording, management and publishing contracts. The service can also assist in negotiating contracts through to completion at no extra cost to the member.

Paul Gray is the National Organiser for Wales and Regional Organiser for South West England for the MU and former bassist / songwriter for The Damned.
