Description

Will drafting gets no easier. Possibilities for negligence abound. This session looks at common pitfalls and suggests strategies for minimising risk. Content may change depending on decisions and legislation in the next few months.

This session will look at problems and good practice in relation to:

• Duties in relation to capacity and undue influence
• Is client free to deal with assets?
• Drafting to secure the residence NRB: tips and traps
• Do you need a governing law clause?
• What do you need to know about Wills Act 1837, s33?
• Drafting for the “what if?”: accrual clauses and substitutional gifts
• Pitfalls in relation to joint property
• What sort of a trust for vulnerable beneficiaries?
• What to do about foreign property?
It will include examples and precedents.

The ever-popular leading speaker in this area, Professor Lesley King, is a former member of the Probate & Estates Committee of STEP, a former member of the Law Society’s Wills & Equity Committee and an honorary member of the Association of Contentious Trust and Probate Specialists. She is Professional Development Consultant at the University of Law.

She is co-author of Wills, Taxation and Administration: A Practical Guide; A Modern Approach to Wills, Administration and Estate Planning (with Precedents); A Modern Approach to Lifetime Tax Planning for Private Clients (with Precedents); A Practitioner’s Guide to Wills; The Will Draftsman’s Handbook; Wills: A Practical Guide; and editor of The Probate Practitioner’s Handbook.

She is a contributor to the Wills and Trusts volumes of Halsbury’s Laws and the Encyclopaedia of Forms and Precedents and to The Law and Ethics of Dementia.

She is the wills and probate columnist for the Law Society Gazette, and writes and lectures extensively on wills, taxation and related matters.

Please note that this seminar will currently be held in the Ranmore Suite on the Ground Floor at Denbies Wine Estate, Dorking, though the venue may be subject to change. Registration is from 1.30pm with tea and coffee. The session will commence at 2.00pm and finish at 5.15pm with a 15 minute break at about 3.30pm for tea.
