How do Churchill Orders affect party engagement in mediation? The CMC Commercial Working Group explores the practical impact for mediators.

The webinar will provide an opportunity for discussion and shared learning on one of the most significant recent developments in the mediation landscape. Following the decision in Churchill v Merthyr Tydfil County Borough Council, the courts can now order parties to engage in non-court-based dispute resolution processes. Mediators are increasingly encountering cases in which participation in mediation or other forms of ADR has been directed by the court, raising important questions about how such orders influence party engagement and outcomes.This webinar, organised by the Civil Mediation Council Commercial Mediation Working Group and led by Carolyn Jones, will explore the practical impact of Churchill Orders from the mediator’s perspective. The group work to promote the resolution of conflicts and disputes by encouraging the use of mediation in commercial matters.They work to foster links with business and industry and legal industry bodies to explore opportunities for the promotion of commercial mediation. They also aim to collaborate with other CMC working groups to co-ordinate approaches across different sectors.
