Copyright Licensing

Licences are the tool used by rights holders to enable the reuse of their intellectual property assets. This detailed intermediary course provides a solid grounding in how licences are intrinsic to the use and the protection of copyright works.

Learning Objectives:

  • Analyse the role of copyright licensing in different settings.
  • Be able to describe the differences between transactional, open and collective licensing.
  • Interrogate the function of collective licensing bodies, the types of rights holders and works they represent and the main principles underpinning their licences.
  • Discuss open access licensing with specific reference to Creative Commons licences.
  • Examine issues associated with eBook licensing.
  • Understand importance of organisational documentation and sharing of information about copyright licences.


Copyright and Commissioning

Copyright will arise wherever content is being commissioned. To protect rights and maximise investment, organisations need to use contractual agreements which include clauses in which copyright ownership and use are clarified. In this course, you will learn about simple, practical tools and frameworks to help you when commissioning others, including artists, photographers, film makers, musicians, designers, or writers.

Learning Objectives:

  • Understand how copyright and other Intellectual Property (IP) can arise in commissioned content.
  • Perceive copyright issues from the commissioned party’s perspective.
  • Dissect key IP principles used in contracts.
  • Be able to select IP clauses appropriate to their organisation’s needs including commercial exploitation of commissioned content.


Exceptions to Copyright

Exceptions to copyright provide opportunities to use copyright protected works without the need to get permission from rights holders. However, they can only be used in specific contexts defined by the Copyright, Designs and Patents Act 1988; as amended and revised. This intermediate course explores exceptions to copyright and how they can be used to support a broad range of activities.

Learning Objectives:

  • Refresh your knowledge about key principles of copyright.
  • Interrogate the principles underpinning the exceptions to copyright.
  • Analyse the difference between the exceptions to copyright and licences.
  • Discuss how the exceptions operate internationally.
  • Explore the meaning of Fair Dealing.
  • Interrogate the main exceptions to copyright outlined in the CDPA 1988 and how the exceptions can be applied.
  • Analyse risk management when considering the use of the exceptions.


Managing Orphan Works

Orphan Works (works in copyright where rights holders are unknown or cannot be traced) present substantial issues in terms of digitisation and publication of copyright works. This workshop will review the extent of the issue, reasons for orphan works and the options for how they can be managed and used. Participants will be encouraged to plan their own next-step strategies for the management of orphan works during the course.

Learning Objectives:

  • Analyse what constitutes orphan works and the different types that exist.
  • Discuss the management of rights and risks following Brexit.
  • Examine possible solutions to orphan works, including risk management and what constitutes a reasonable search.
  • Consider and plan practical strategies to manage orphan works.
  • Determine how to manage risks within the context of orphan works.
  • Review the EVA approach to take down and what to do if a rights holder comes forward.
  • Embed learning into work context.


Commercial Licensing

Commercial Licensing is the process of licensing the use of Intellectual Property (IP) assets such as a trade mark or a copyrighted work. It can be a lucrative source of income. This course uses case studies, scenarios and discussions to enable you to navigate the steps required to develop the commercial potential of your assets.

Learning Objectives:

  • Identify potential revenue stream options and analyse associated costs ensuring a return on investment.
  • Interpret the steps to protect your IP assets such as the process for registering trade marks and use of contractual clauses to protect your IP.
  • Identify the different types of licensing partners and which ones might be appropriate for you.
  • Outline your next steps and priorities for commercialising your assets.
