Scottish Mediation

This year’s conference is going online and has taken advantage of this to present speakers from across the globe.

Taking place over 2 days on the 16th and 17th November, our theme for the conference is shaping the future. On our first day we will look at the future of online dispute resolution drawing on experiences of the courts in the USA. We’ll also look at how our own Covid-19 Mediation Service and our colleagues in British Columbia will shape our thinking going forward. On our second day some of the core ideas of mediator independence and impartiality come under the microscope. Are these still what matters or is a focus on ensuring party self determination what matters. We’ll also look at how mediators can build their resilience and creativity at a time when people are under great pressure.Day 1Monday 16th November 2020 - 2pm-5pm Day 2Tuesday 17th November 2020 - 1pm-4pm Day 1 KeynotePaul Embley Will talk on his experiences of ODR and mediation in the courts.Paul Embley is the CIO and Technology Division Director at the National Center for State Courts. He began his career in Silicon Valley working for the “who’s who” of high tech (along with several of the “who’s no longer”). After 25 years in the for-profit sector, Paul shifted to the public sector work on integrated justice. He has gleaned broad product lifecycle expertise from diverse and challenging projects in US states and territories, Australia, many EU nations, and several emerging democracies including Haiti and Nigeria. He has lead justice-related IT assessments and technology initiatives ranging from child welfare and terrorist watchlist to online dispute resolution. He continues to follow potential disrupters such as blockchain and machine learning/data science looking for ways those disrupters might be used advantageously in courts and with justice partners. He is currently involved in international, national, and localized technology initiatives for criminal and civil justice with a special emphasis on ODR.Paul has become one of the leading experts in US State Court utilization of ODR. He has participated in panels and delivered presentations at international ODR gatherings including Liverpool, London, Auckland, and Zagreb, as well as a variety of US technology conferences. He looks forward to the day when justice is accessible to more than just for 20% of the population.Day 1 WorkshopsMediate British Columbia and May MillwardA collaborative session with Mediate BC on experience of mediation during covid and looking at their and our schemes and reflecting on what has happened.Young People and the Future - Encouraging Positive ConversationsKathryn Hilditch and Sarah Welsh will explore how we can engage young people in the skills of dispute resolution and give them skills for life.Day 1 Panel DiscussionBuilding Back Better with Mediation, what would it look like?Looking at developments in different sectors we&#x27;re delighted to present three speakers who will focus on developments in their areas and what the possibilities are for further development of mediation.Sarah Allen – Scottish Land CommissionRachel Bicknell – Squaring CirclesDr Claire Macaulay – Medical Mediation FoundationDay 2 KeynoteRachael Field and Jonathan CroweAuthors of a new book Mediation Ethics: From Theory to Practice. In the book they note that traditional ideas of mediator neutrality and impartiality have come under increasing attack in recent decades. There is, however, a lack of consensus on what should replace them. They argue that Mediation Ethics offers a response to this question, developing a new theory of mediation that emphasises its nature as a relational process. They argue that mediation ethics should move away from the untenable notions of mediator neutrality and impartiality and towards a focus on party self-determination. They supplement this focus with a view of mediation ethics as emerging dynamically from the efforts of mediators to respond to the unique needs and interests of the parties. This new paradigm provides the basis for a picture of the mediation profession as a community with its own internal standards of excellence, as well as a more sophisticated and realistic ethical framework for mediation practice. Academics in law, social work and psychology will appreciate the book&#x27;s nuanced account of the dynamics of mediation as a dispute resolution process. Mediation practitioners, including lawyers, social workers and counsellors, will find the book a practical and helpful guide to addressing ethical dilemmas. And students of mediation will benefit from the book&#x27;s clear and up to date overview of the development and principles of mediation ethics.Day 2 WorkshopsLucy Gower - Getting unstuck - build your resilience and creativity When the world is changing fast, our ability to respond to change, to bounce back and learn from failure become more important than ever before. We need to think creatively to solve problems, and stay positive for those around us, all while managing our own rollercoaster of emotions.However, in times of change and uncertainty, our anxiety levels rise. It’s hard to think straight, let alone be creative when we’re feeling stressed out. This makes it very difficult to access the creative thinking parts of our brains needed to solve problems effectivelyIf you’re having the same conversations over and over again but don’t feel you’re getting anywhere, if you feel tired out, distracted or that your ability to think straight is weakening this workshop will help.
