Scottish Mediation

Our theme is from Anna Howard's book . Do we need to be changing the frame to view the use of mediation through the lens of the disputants?

Taking place over two half days our theme this year is abut Changing the frame of mediation in order to widen engagement with it across society. On Monday we hear from David Liddle who is not only a successful author on management and organisations but also CEO of the TCM group delivering workplace mediation across the UK. `We finish the day with a panel discussion on what we have learned from online mediation and what the future holds. On the Tuesday we welcome Liz Stokoe Professor of Social Interaction at Loughborough University. Her recent research relates to what many view as core aspects of mediation practice, rapport building and the use of open questions. We&#x27;re sure that what she has to say will raise some eyebrows and challenge our views. We finish the conference with the person who has provided the inspiration for our theme, Dr Anna Howard. Through her research on cross border mediation she has found that if we are to se a greater use of mediation we need to promote it in a way which complements rather than being posed an an alternative.Over the two days there will also be a range of workshops providing an opportunity for discussion and to meet other delegates.Day 1Monday 15th November 9.00am-1.00pmDay 2Tuesday 16th November 1.00pm-5.00pmDay 1 KeynoteDavid Liddle, CEO of the TCM Group and author of Managing Conflict and Transformational Culture.David has had a long involvement in mediation setting up the TCM Group to amongst other things provide workplace mediation. One of the key things he has been responsible for developing is the idea of a resolution policy for organisations which encourages early dispute resolution and the use of dialogue and mediation. In his most recent book , Transformational Culture he looks at the benefits for organisations in adopting such policies that go beyond HR and to the core of business. Day 1 WorkshopDiversity and Mediation how are we doing in ScotlandDay 1 Panel DiscussionWhat have we learned from mediating online and what can we learn for the future? Our panel featuring Rosanne Cubitt from Relationships Scotland and Stephen Chubb from the Scottish Legal Complaints Commission will lead a session exploring what the explosion in online mediation has taught us about mediating online, how it&#x27;s been for mediators and the parties and what role online will play in the future.Day 2 Keynote 1Liz Stokoe, Professor of Social Interaction at Loughborough University and author of Talk: The Science of Conversation and of Crisis Talk: Negotiating with Individuals.Liz has recently completed work on two of the key mediation practice aspects common across mediation training. The first the need to build rapport with clients and the second the need to ask open, not closed questions. In her presentation she will challenge these notions and ask mediators to consider her findings. Attendees at previous conferences have enjoyed Liz&#x27;s interactive presentation style Day 2 WorkshopsPeer Mediation in Argentina - How does it work and what can we learn? The Future of Community Mediation - Victoria Harris CEO of Mediation Hertfordshire will introduce their recent report Transforming Community ConflictDay 2 Keynote 2Dr Anna Howard author of EU Cross-Border Commercial Mediation: Listening to Disputants - Changing the Frame; Framing the Changes.Anna&#x27;s research for her book drew the to the conclusion that trying to engage people in mediation with the idea that it is an alternative to litigation does not work effectively. However promoting mediation as an assistance to and kick start for negotiation is much more effective. In the session the aim is to understand Anna&#x27;s work and then to look at how we apply the lessons to other areas of mediation, hence the phrase Changing the Frame, framing the Changes.A Zoom link for the event will be sent to all registered participants nearer to the time.
