This session is specifically for local authority officers who are involved in carrying out accident investigations that may result in legal action under criminal law. Specifically, this session will use discussion , case studies and examples to cover the following:

The 4 elements of an investigation including the all important 'Golden Hour'
Importance of early enforcement decisions
Relevance ofimmediate cause, underlying causes and root cause analysis
Application of the CPS Code for Crown Prosecutors and when to prosecute
Identification of suspects and who to invite for an interview under PACE
Building your case
Applying root cause analysis to an investigation and identifying the immediate and underlying causes
Consideration of PACE when investigating an accident
Clarification of HSW S20 when questioning witnesses
HSW S20 questioning compared to CJA voluntary S9 statements
Gathering evidence and use of experts
Understanding your powers under HSW S20 and their application
Interviewing witnesses and common complications and issues
Dealing with common problems including reluctant witnesses and uncooperative suspects

Previous knowledge and experience of incident investigation would be an advantage, but not an essential requirement. Experience of local authority investigation work will be useful, as well as experience of preparing and taking a prosecution, but again, not essential.
