Course aim:

Delivered by Alcohol Change UK, the aim of this course is to encourage and enable professionals in England to use legal frameworks to manage and protect people with chronic alcohol or drug dependence. Its focus is on how to make the most effective use of the three main legal powers which can protect vulnerable people. In addition, it emphasises the importance of a process framework that will enable the powers to be used most effectively.

Learning objectives

By the end of the course, participants will be able to:

• Identify people with chronic alcohol or drug dependence who require the protection and support of key legal powers

• Challenge the “lifestyle choice” paradigm that impedes the care of this group.

• Understand how the Care Act (2014) or Social Services and Wellbeing (Wales) Act (2014) apply to this group

• Case study work on the use of these Acts, drawing on participant experience and Safeguarding Adult Reviews

• Understand how the Mental Capacity Act (2005) applies

• Case study work on the use of the Mental Capacity Act, drawing on participant experience and Safeguarding Adult Reviews

• Understand how the Mental Health Act (1983) applies

• Understand other legal frameworks that can apply to this group, e.g. Human Rights Act and Inherent Jurisdiction

• Understand what interventions flow from action under these powers - developing a robust care plan that is in someone’s best interest
