Following the training course, there will be an opportunity to ask questions of a specialist SEND solicitor in a Q&A session run after the training from 3:00pm - 4:00pm.

Being a SENDCo fulfils a very important role in any school. However, the relentless level of paperwork and the expectation that a SENDCo understands the legalities connected to funding, EHCPs and the EHC needs assessment process can be a significant challenge.

To help SENDCos with their understanding of SEND law and funding, Birkett Long’s Education Team has created specialist training for SENDCos and teaching professionals. The training aims to provide SENDCos and teaching professionals with a detailed and well-rounded understanding of SEND law, EHCPs and funding.

This one-day course has been developed to cover everything SENDCos and teaching professionals need to know about SEND law, EHCPs and funding.

T here are three parts to the training:

Part 1 - SEND law

  • What is SEND law and where can I find it?
  • The SEND law framework and key legal definitions
  • What are the SEND law duties on local authorities?
  • What are the SEND law duties on nurseries, schools and colleges?
  • What is the legal process of obtaining an EHCP
  • What rights do parents, carers and young people have if they or their child has an EHCP?

Part 2 - EHCPs

  • How to obtain an EHCP
  • What should the structure of an EHCP be and what should be included in it?
  • Section B of an EHCP - detailing special educational needs
  • Section F of an EHCP and the requirement to detail provision in a specific and quantifiable way - legislation, guidance and case law
  • Section I of an EHCP and naming a school - legislation, guidance and case law
  • Annual reviews
  • Re-assessments - what are they, when should they be used and what are the benefits and potential implications?

Part 3 - Funding

  • The legal framework for school funding
  • Types of funding
  • The law on the EHC needs assessment process and LA policy
  • A closer look at Section F, provision and funding
  • The truth about common funding myths
  • Common issues education settings face with funding
