Dr Seamus Byrne is a researcher in Manchester Law School. He will talk about his research, rights and play for children with special educational needs and disabilities.

"The Fallacy of Play: Children and Disability”

In this talk, the right to play for children with special educational needs and disabilities (SEND) will be examined. Firstly, the international legal framework, from both a children’s rights and disability rights perspective will be unpacked. This will demonstrate that despite the outward legal protections which appear to objectively protect, and give effect, to the right to play, its practical translation into an accessible right for children with SEND has remained immensely problematic and constrained in practice. Following on from this, the domestic (English) position as regards the right to play for children with SEND will be explored, which will be followed by an examination of service provision at the localised level in Manchester. It will be ultimately contended that much work remains to be done to uphold and give practical effect to the right to play for children with SEND, to avoid it becoming a hollow human right.

Dr Seamus Byrne Biography

Seamus is a Reader in Law in Manchester Law School. His research interests and expertise revolve around children’s rights, and in particular the rights of children with special educational needs and disabilities (SEND).
