This session will provide practitioners with tips, examples and the tools to argue cases under the test of unjustifiably harsh consequences/exceptional circumstances under Article 8 ECHR.

• Home Office Policy Guidance and how to make best use of it
• Authorities on ‘unjustifiably harsh consequences’ – with analysis of circumstances the Courts have found to meet the test and those which they have not been convinced by
• Case studies
